About PRESCIENT and these terms

These Terms & Conditions govern purchases from PRESCIENT at prescientclothing.com and use of our store's services. Read them together with our Returns Policy and Privacy Policy. Joining our optional text-message program is not a condition of buying from us. SMS consent is collected separately.

These terms do not exclude or limit any consumer right or remedy that cannot lawfully be excluded or limited. If a term conflicts with a mandatory right, that right prevails. Our Privacy Policy explains information handling; it does not replace any separate consent required for marketing or cookies.

Using the store

You must have legal capacity to enter the transaction, or use the store with the involvement of a parent or legal guardian where permitted by law. Provide accurate contact, delivery and payment information. Keep account access details secure and notify us if you believe your account has been used without permission.

Do not use the store for fraud, unlawful activity, infringement of others' rights, spreading malicious software or interference with the store's operation. We may restrict access for a reasonable security or legal reason, while respecting existing orders and your statutory rights.

Products, availability and prices

Read the product description, materials and measurements before ordering. We aim to describe products accurately. Screen settings may affect how a color appears, but this does not excuse materially inaccurate descriptions or goods that do not conform to the contract.

Availability and prices may change before an order is accepted. The checkout displays the currency, product prices and charges we collect for your order. Review the total and delivery details before paying. A price change does not change the agreed price of an accepted order.

If we discover a material pricing, availability or description error affecting an order, we will contact you to explain it and offer any options required by law. We will not charge a higher amount without your agreement. If we cannot fulfill the order and it is canceled, we will refund the amount paid as required by law.

Orders and payment

Submitting an order is a request to purchase the selected goods. We accept your order when we send an order-confirmation email confirming your purchase. We may decline an order before acceptance for a reasonable reason, such as unavailable stock, an unresolved material error, payment failure or suspected fraud. We will notify you and return any payment due. Once an order is accepted, neither these terms nor a later website update gives us an unrestricted right to change or cancel it.

You authorize the payment method you choose to be charged for the amount shown at checkout. Payment processing is handled through the payment services available in checkout. We may request information reasonably necessary to verify a payment, without asking you to send full payment-card details by email.

Delivery and cancellations

Delivery options, costs and any available estimates are shown during ordering. Product-specific preorder or production information, when applicable, should be reviewed before payment. We will provide the notices and cancellation or refund options required by law if an order cannot be shipped or delivered as agreed. We will not rely on an estimate to remove those rights.

Tell us promptly if delivery information is incorrect or an order is missing or damaged. We will investigate with the relevant fulfillment provider or carrier. A carrier's involvement does not remove any responsibility we have to you under applicable law.

Final sale and your statutory rights

Purchases are final sale except where applicable law requires a return, cancellation, refund or other remedy. We do not offer voluntary change-of-mind returns, exchanges or refunds, including for a size selection or preference change. Our Returns Policy explains the process and statutory exceptions, including applicable cooling-off rights and remedies for faulty, damaged, incorrect or misdescribed goods. Nothing described as final sale, preorder or made to order overrides those protections.

Intellectual property

Store content, including original designs, branding, photography and text, belongs to PRESCIENT or its licensors where protected by law. You may browse and use the store for lawful personal shopping. Do not reproduce or commercially exploit protected content without the relevant rights holder's permission, except where the law allows it. Buying a product does not transfer ownership of the associated intellectual property.

Shopify and third-party services

Our store is hosted by Shopify. Product purchases are made with PRESCIENT; Shopify supplies the commerce platform. Our store uses Shopify Network Intelligence and related enhanced services. Subject to applicable consent requirements and privacy choices, Shopify processes information from interactions with our store together with information from other merchants to provide services such as personalization, performance improvements and advertising support. Third-party websites and services linked from the store may have their own terms and privacy notices. Their presence does not change our obligations to you for purchases made from PRESCIENT.

Responsibility and mandatory protections

We will use reasonable care and skill in providing our services and will provide the product remedies required by law. We cannot promise uninterrupted website availability, but an interruption does not cancel your rights concerning an existing order.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Nothing removes a mandatory product guarantee or remedy. Any limit on a party's responsibility applies only to the extent permitted by the law governing the particular claim.

Questions, disputes and applicable law

Contact info@prescientclothing.com with an order number and a description of the issue so we can try to resolve it. Contacting us is not a condition of exercising any legal remedy, and it does not shorten a legal deadline.

These terms are governed by California law, except where another law applies mandatorily. If you are a consumer, this choice does not deprive you of the mandatory protections of the country or state where you habitually reside, or any right to bring a claim in a court available to you under applicable law. These terms do not require arbitration or waive a right to participate in a class action.

Changes and remaining provisions

We may update these terms for future transactions by publishing a revised version and its update date. Where the law requires notice or consent, we will provide or obtain it. Changes do not retrospectively change an accepted order or remove accrued rights. If a provision cannot be enforced, the remaining provisions continue to apply to the extent lawful.
